Terms of Service
Effective Date: 15.10.2024
General Terms and Conditions (GTC) of beyond-peptides.com
1. Scope and Provider
These General Terms and Conditions (GTC) apply to all contracts, deliveries, and services provided by BP RESEARCH Sp. z o.o. (operator of the website beyond-peptides.com) to its customers. The contracting partner and provider of the products is BP RESEARCH Sp. z o.o., ul. Młyńska 16/8, 61-730 Poznań, Poland (Commercial Register KRS 0001130178). Contact: Email contact@beyond-peptides.com.
Within these terms, a consumer is defined as any natural person who enters into a legal transaction primarily for purposes not attributable to their commercial or independent professional activities. An entrepreneur is any natural or legal person or partnership that acts in the execution of their commercial or independent professional activity when concluding the contract. Certain provisions in these GTC distinguish between consumers and entrepreneurs and apply explicitly to the respective customer groups as indicated. By placing an order, the customer agrees to these GTC.
2. Product Information and Usage Restrictions
The products offered (particularly peptides and related chemical substances) are sold exclusively for research purposes. They are not intended for use on or in humans or animals, particularly not for diagnostic, therapeutic, medical purposes, or human or animal consumption. The customer explicitly confirms during the ordering process that the products are purchased solely for in-vitro research and laboratory purposes and must under no circumstances be consumed or otherwise applied to humans or animals. Any misuse—including but not limited to usage as food, dietary supplement, medication, cosmetics, commercial purposes, or illegal substance production—is strictly prohibited. The products may only be used by qualified personnel in suitable, secured laboratory facilities complying with all applicable safety regulations.
Important note: The chemical, physical, and toxicological properties of the peptides and chemicals offered may not yet be fully researched. BP RESEARCH Sp. z o.o. does not assume liability or guarantee that the products are suitable or safe for any particular purpose other than the stated research purposes. Specifically, the goods have not been tested for safety or effectiveness for human use, medicinal purposes, as food additives, or for medical devices. The customer uses the products at their own risk within the permitted research usage.
Additionally, the customer confirms with their order that they are of legal adult age (at least 18 years old). Persons under 18 years are excluded from purchasing our products. Orders and purchases are permitted exclusively for legally competent adults; customers must confirm their legal age during the ordering process. BP RESEARCH has no obligation for additional age verification; customers bear responsibility for all consequences resulting from incorrect information.
3. Conclusion of Contract
The presentation of products in the online shop (beyond-peptides.com) does not constitute a legally binding offer but merely an invitation to the customer to submit an offer to purchase (invitatio ad offerendum). Customers can select products from the assortment and collect them using the “Add to cart” button. During checkout, customers enter required contact details, select shipping and payment methods, and receive an overview for review before placing the order. Input errors can be corrected there, or the order can be canceled by closing the browser. By clicking the button “Place order with payment obligation” at the final step, customers submit a binding order (contract offer) for the items in their cart. Immediately after placing the order, customers receive an automated email confirmation, which only documents receipt of the order and does not constitute acceptance. The purchase contract becomes effective only when BP RESEARCH explicitly accepts the order by email confirmation or ships the goods within a reasonable period and confirms dispatch to the customer.
Contract language: The language available for contract conclusion is English. Any translations of these terms (e.g., German) are for convenience only. In case of discrepancies, the English version shall prevail.
Storage of contract text: We do not store the contract text (order details and terms) in retrievable form. Customers can print their order details immediately after submitting the order or await the order confirmation. With shipping or order confirmation, customers receive contract terms (including these GTC) via email.
4. Customer Account and Website Usage
The online shop can be used either as a guest or through a registered customer account. Customers creating an account are responsible for maintaining confidentiality of their access data. The account is personal and must not be transferred to third parties. Customers must keep their account information (especially contact and shipping details) accurate and up-to-date. An account can be deleted at any time. BP RESEARCH reserves the right to block or delete accounts due to violations of these terms or legal requirements.
5. Prices and Payment Terms
Prices: All prices listed in the shop are final prices, including statutory VAT and excluding shipping costs unless otherwise indicated. Additional costs (e.g., customs duties for shipments outside the EU) are not included in prices (see Shipping and Customs section). If an obvious pricing error occurs, we reserve the right to inform the customer before dispatch and potentially withdraw from the contract if the customer is unwilling to pay the correct price.
Payment methods: Payment is exclusively in advance. Offered payment methods are:
Bank transfer (payment to our Polish bank account, provided during checkout).
Bitcoin (cryptocurrency). Customers receive a wallet address and the amount to transfer in Bitcoin. Transaction fees are borne by the customer. Orders are considered paid only after confirmation of the transaction.
PayU (payment service provider). Customers are redirected to PayU’s site for payment processing (e.g., credit cards, local payment methods). Additional PayU terms may apply.
Payment is due immediately upon contract conclusion. Delivery occurs only after complete payment. Statutory provisions apply in case of delayed payment.
Bitcoin Payments:
- Payment Confirmation: Bitcoin payments are considered confirmed only after the required number of network confirmations.
- Exchange Rate Fluctuations: Due to the volatility of cryptocurrencies, the amount due may include a surcharge of up to 0.5% to account for exchange rate fluctuations.
- Payment Shortfalls: If the Bitcoin payment received is more than 2% below the order total due to exchange rate fluctuations or transaction fees, we reserve the right to reject the payment and cancel the order.
- Refunds in Bitcoin: Any refunds for Bitcoin payments will be processed in Bitcoin and may be subject to exchange rate differences.
6. Delivery and Shipping
We ship worldwide. Delivery methods include GLS, UPS, or DHL depending on the destination and availability. BP RESEARCH selects the carrier based on speed and safety considerations. Estimated delivery times provided during checkout are non-binding.
Shipping costs: Costs are borne by the customer, displayed separately during checkout based on shipping method and destination country. Any additional local fees are borne by the customer.
Delivery occurs at the customer’s provided address. Partial deliveries are allowed if reasonable. Customers are promptly informed of delays. If deliveries fail due to the customer’s fault (incorrect address or refusal to accept delivery), the customer may bear resulting costs.
Risk transfer: For consumers, BP RESEARCH bears the risk until delivery. For entrepreneurs, risk transfers upon handover to the shipping provider.
7. Import, Customs, and Legal Regulations in Recipient Country
Deliveries outside the EU may incur additional import taxes, duties, or fees, borne by the customer. Customers must inform themselves of local import and customs laws. BP RESEARCH assumes no liability for compliance with country-specific regulations or import legality. Legal consequences of non-compliance are the customer’s responsibility.
8. Retention of Title
Goods remain BP RESEARCH’s property until full payment. Entrepreneurs are permitted to resell reserved goods, assigning receivables from resale to us until settlement.
9. Right of Withdrawal for Consumers
Consumers have a 14-day withdrawal right from receipt of goods. Goods must be returned promptly, and customers bear return shipping costs. Opened sealed goods or customized products are excluded from withdrawal.
10. Warranty and Liability
Statutory warranty rights apply for consumers. Entrepreneurs must inspect goods immediately and report defects promptly. BP RESEARCH’s liability for minor negligence is limited to foreseeable damages from essential contractual obligations. Liability for improper product usage is excluded.
11. Final Provisions
Polish law applies, excluding UN sales law (CISG). Exclusive jurisdiction for entrepreneurs is Poznań, Poland. Consumers retain legal jurisdictional rights. EU online dispute resolution platform: https://ec.europa.eu/consumers/odr/. Changes to contracts or terms require written form.
